§ 1 General provisions
These NUSA SPA terms and conditions apply to all Nusa SPA and Hati Massage salons, brands belonging to NUSA SPA SP. z O. O., KRS No. 0000990609 (hereinafter referred to as the” NUSA SPA terms and conditions”) and define:
a) general recommendations and rules for the use of Nusa SPA salons; b) recommendations for preparing for the massage, the procedure after it, as well as the most essential contraindications to massage treatments in the salons of NUSA SPA; C) rules for the implementation and use of NUSA SPA promotional packages, which consist of vouchers, loyalty cards, VIP passes and promotions for selected services or treatments (“promotional packages”).
I. Rules applicable to NUSA SPA salons:
1. Before proceeding to the procedure, the customer is obliged to fill out and sign the customer card. The information contained in it can be used to assess the contraindications for the use of individual treatments in the NUSA SPA salon, as well as the correct selection of the type of treatment. In case of contraindications, NUSA SPA has the right not to admit the client to the procedure.
2. By using the services of NUSA SPA, booking a treatment and ordering a promotional package, the customer declares that he has read these Terms and conditions, does not raise any objections to it and undertakes to comply with it.
3. The client acknowledges that the Nusa SPA massage parlors are a zone of silence and relaxation and undertakes to refrain from making noise while respecting the peace of his and other clients.
4. NUSA SPA reserves the right to refuse to perform the treatment and to ask to leave the salon of a person whom it suspects to be in a state after the use of alcohol or other drugs or for any other reason behaves inappropriately.
5. The client is obliged to read the list of contraindications for performing massage treatments available in para. II below. It is the client’s responsibility to verify that he/she can safely use the selected service in the NUSA SPA massage salon.
6. The use of the massage service is possible as a result of an earlier appointment via the website Booksy.com, at the reception of the salon or by phone at the phone numbers available on the website nusaspa.pl.
7. We ask customers of Nusa SPA massage salons to be punctual and arrive at the salon at least 5 minutes before the planned treatment, and in the case of the first visit to the Nusa SPA massage salon – at least 10 minutes before.
8. If the client is late in relation to the booked start time of the procedure, this does not affect the time of its completion. The client is aware that NUSA SPA massage parlors ensure take proper cleaning and hygiene in the massage rooms room in to prepare him for the following procedure. NUSA SPA also makes every effort to ensure that scheduled massages start on time.
9. Cancellation or change of the date of the appointment is possible by phone or sms to the phone numbers of the massage parlor where the appointment was made, or by e-mail to biuro@nusaspa.pl at least 24 hours before the scheduled visit. Otherwise, the arranged visit will be treated as held and will be settled by the NUSA SPA salon in cash, in the form of a completed customer voucher or in the form of a completed massage with a VIP pass.
10. The masseur has the right to refuse to perform the massage without giving a reason, in particular in the event of any violation of the safety or comfort of the employees of the NUSA SPA massage salon or other customers, with the obligation to pay by the customer. The masseur has the right to interrupt the massage at any time and ask the client to leave the massage parlor.
11. The customer is responsible for the items brought to the salon. A liability insurance policy covers Nusa SPA salons. Nusa SPA salons are covered , and their liability is limited to the policy’s limits.
12. The client is aware that certified therapists are employed in NUSA SPA massage salons from Indonesia or Thailand, who communicate primarily in English. Each therapist in our salons is qualified and experienced person. Nusa SPA salons remain a network of holistic spas and do not provide medical or physiotherapy/rehabilitation services, although the treatments performed have health and relaxation properties.
13. If you have any questions or problems, please get in touch with the staff of the NUSA SPA massage salons. We are here for you, not the other way around.
II. Preparation for massage. Contraindications to the use of massage treatments in Nusa salons. Recommendations after the massage.
Preparation for massage:
14. In the Nusa SPA massage salons, we focus on customer service at the highest level. Therefore, we ask each of our clients to:
- arrive to the NUSA SPA massage salon punctualy, preferably a few minutes before the planned treatment; all customers are kindly requested to read the terms and conditions in advance and fill out the customer card (together with a conversation with the service it takes approx. 2-3 minutes);
- remove jewelery before the massage (earrings, watch, chain etc.) and place it in the indicated place in the treatment room or hide it in your own area;
- report to the reception staff and marking in the customer card information about which parts of the body should not be subjected to massage, in particular in the area of the face, head and abdomen;
- before the massage – after entering the indicated massage room – change into disposable underwear prepared for you, click on the button informing the therapist about the readiness for the massage, lie comfortably on the massage table and cover yourself with a large towel;
- relax and allow our qualified therapists to assist you;
- read the NUSA SPA terms and conditions in advance.
Contraindications:
15. Massages performed in Nusa SPA salons, as a rule, belong to safe procedures and have a health-promoting effect on the human body. However, certain circumstances may constitute contraindications to performing a massage. Some of them can be leveled by omitting certain body parts of the body, choosing the type of treatment, and adjusting the massage technique and the force of pressure. There are also cases in which it is not necessary to perform a massage or consult a doctor beforehand. That is why it is so important to inform reception staff and the therapist of any contraindications.
16. The most common contraindications to the use of massage should include:
- unhealed scars, skin inflammations, varicose veins (in such cases, you can massage only healthy parts of the body);
- phlebitis;
- menstruation (it is not recommended to massage the abdomen on the first day and during painful menstruation);
- pregnancy (period and trimester of pregnancy and last month, complications-should remain under the supervision of a doctor);
- tuberculosis;
- epilepsy;
- osteoporosis;
- haematomas, aneurysms;
- skin changes, including all kinds of skin allergies, chicken pox, skin fungus;
- inflammation;
- common cold;
- elevated body temperature (above 37.5°C);
- infectious diseases;
- heart disease, hypertension;
- peptic ulcer disease;
- diabetic complications;
- cancerous changes-during their occurrence and the next 5 years after their removal;
- acute inflammation (pneumonia, bronchitis);
- early post-traumatic stress disorder (dislocation, sprain);
- cholecystitis.
- allergies to cosmetics used for massage;
- hepatitis;
- bone fracture and fresh adhesions (up to 6 months post-adhesion);
- peptic ulcer disease with bleeding;
- liver and kidney stones.
In addition, contraindications to the use of facial massage should include:
- herpes;
- acne;
- inflammation of the oral cavity;
- bacterial tonsillitis;
- enlarged lymph nodes;
- the first 3 days after tooth extraction;
- lichen planus, seborrheic dermatitis;
- viral, bacterial and purulent conditions;
- breaking the continuity of the epidermis in the treatment area;
- nodules of unknown origin;
- hyperthyroidism;
- face fillers – a minimum of 14 days interval before the massage, preferably a month;
- face botox – a minimum 14 days before the massage, preferably a month.
The above list of contraindications is not a closed catalog.
Recommendations after massage:
17. Recommendations after the massage:
- after the massage, it is recommended to have a 15-minute rest. Ideally, you can take advantage of the brine thaw or relax with the soothing sound of the fountain. In that case, this period is used to restore a regular heart rate and help adaptation the body adapt after the procedure.
- for another hour after the procedure, you should maintain proper hydration of the body and gradually replenish fluids; m.in. ginger brew served in our living room;
- protect massaged areas from getting cold – you can also wear an extra layer of clothing to keep your body warm;
- after the massage, it is not recommended to make increased effort; optimally, if you can afford to continue to relax;
- as a rule, immediately after the massage, it is not recommended to take a shower – it is worth allowing the oil to be absorbed into the body and nourish the skin; if you do not like to have too much of the product on the skin after the massage, tell the therapist about it, and also do not hesitate to wipe the;
- after the massage, you can feel heat, chills in the areas covered by the massage, tenderness in individual parts of the body, general fatigue, and drowsiness. Do not worry – this is a natural reaction of the body to massage, which has an effect, m.in. on the circulatory, lymphatic, and nervous systems. A stimulated body also needs regeneration, which you can provide it with rest and sleep. When you are just starting your massage adventure, these reactions can last up to 72 hours after the procedure. After 2-3 massages, the body begins to get used to and adapt to get used to and adapt gradually gradually get used to and adapt.
III. Rules for the implementation and use of Nusa SPA promotional packages.
18. Types of basic promotional packages:
- Voucher – entitles the person indicated in it to use the selected massage or use the amount of money specified in it;
- Loyalty Card (KSK) – a card that is awarded to the customer of the NUSA SPA massage salon by the salon reception , entitling the customer to a 50% discount on the 6th or subsequent massage (does not apply to rituals).
- VIP pass – a pass, prepaid by the customer in advance, entitling the customer to 1 or 2 additional free massages of a particular type within the prepaid price.
19. Promotional packages include interchangeably: Balinese Massage, Thai massage, Balinese massage with warm oils, relaxation bamboo massage, and lomi-lomi massage with aromatherapy.
20. Promotional packages are issued in paper form and can be used until the end of the validity period indicated in their content. If the validity of the promotional package is specified as the number of months from the date of purchase, the promotional package is valid until the expiration of the specified number of months, counting from the month following the month of purchase. Promotional packages can also be issued in electronic form, in which case (except for vouchers) they are exchanged for appropriate promotional packages in paper form during the first visit to the NUSA SPA massage salon. Promotional packages are not subject to exchange in whole or in part for money, and the indicated validity period is not extended; upon its expiration, NUSA SPA’s obligation to the customer expires.
21. Each of the promotional packages, except for the Loyalty Card, has an individual identification number. Nusa SPA massage salons register all promotional packages. Nusa SPA massage salons register all promotional packages. NUSA SPA is not responsible for the loss or damage of the promotional package from the moment it is handed over to the customer.
22. Promotional packages do not combine with other promotions or add up. The customer can only use one of them at a time.
23. In the case of quota vouchers, if the value of the goods or services exceeds the value of the voucher, the customer is obliged to pay the difference. Vouchers do not include promotional prices.
24. Upon purchase or receipt of a promotional package, the buyer or holder declares that he has read these Terms and Conditions, accepts their provisions in full, and undertakes to comply with them.
25. Promotional packages are subject to use in the Nusa SPA network, unless otherwise stated in their content.
26. The holder of the promotional package is obliged to pre-book the service. The basis for the promotional service is the prior transfer of the Promotional Package number to the salon staff.
27. The drawer has the right to refuse the implementation of the promotional package in the event of 1) expiration of the validity period of the Promotional Package, 2) loss or damage to the promotional package that makes it impossible to identify it, or 3) lack of Prior reservation of the treatment in the salon. The exhibitor also has the right to exclude individual, selected days or periods from the promotional packages (however, no more than 12 calendar days per year). Exclusions for the use of the voucher or pass are always subject to: February 14 and 15, March 8, May 1 and 3, and December 31.
28. After each treatment, the customer is obliged to ensure that the reception staff of the salon marks the promotional package with the hologram NUSA and affix it with the date of use of the treatment. Self-affixing of markings and filling in of dates are prohibited.
29. Massages that are shorter than the promotional package do not qualify for the promotion. Massages lasting longer than the time indicated in the promotional package will be credited only for the time specified . If the package is used by the owner of the package together with an accompanying person, both persons can benefit from the credit for the massage included in the promotional package, according to the rules in force in the preceding sentences.
30. The buyer, the recipient, or any other designated person is entitled to use the voucher after prior agreement with the reception of the Nusa salon.
31. The buyer and his/her accompanying person are entitled to use the VIP Pass and the regular customer card.
IV. Final provisions:
32. The regulations are valid in the version available at the website address www.nusaspa.pl/regulamin-nusa and in each of the Nusa SPA salons.
33. Changes in the regulations are made by placing its new version at the above address and laying out in the salons of NUSA SPA.
34. In the event of discrepancies between different language versions of the NUSA terms and conditions, the Polish version shall prevail.
INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA BY NUSA SPA
Implementing the requirements of regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons aboutwith the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR”), we inform you about the principles of personal data processing and the rights associated with this:
1. The personal data administrator is a company operating under the name NUSA SPA SP. z O.O. with its Registered office in Warsaw at UL. Puławska 39 lok. 40 (02-508), entered into the Register of entrepreneurs KRS, maintained by the District Court for m.st. Warsaw in Warsaw, XIII Commercial Division, KRS: 0000990609, tax identification number: 5213983070, share capital of PLN 50,000. 00, hereinafter referred to as:”Administrator”. Contact the administrator: email: biuro@nusaspa.pl.
2. The Administrator processes personal data in connection with the performance of the contract (art. 6 para. B GDPR). In addition, data processing will be necessary for purposes other than those indicated above and in connection with the performance of obligations in the field of financial settlements, including tax (art. 6 para. C GDPR). In addition, in some situations, it may be necessary to process data for the implementation of the controller’s legitimate interests (for the purpose of pursuing possible claims). In other cases, personal data will only be processed based onon prior consent, to the extent and for the purpose specified in the content of the consent (art. 6 para. and GDPR).
3. The provision of personal data is a condition for the conclusion and performance of the contract, or results from the fulfillment of obligations arising from the above-mentioned legal provisions, or is necessary to fulfill the purposes arising from those mentioned above, legally justified interests of the administrator. Failure to provide all required personal data will prevent the conclusion of the contract. To the extent that personal data are collected with consent, the provision of such data is voluntary.
4. The data will not be transferred to a third country or an international organization.
5. In connection with the processing of personal data for the above purposes, personal data may be made available to the following recipients or categories of recipients: authorized employees of the administrator; contractors-only in the scope of data necessary to process the reservation, and in the remaining scope only after obtaining a separate, voluntary consent; as well as to public authorities, entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes that result from the provisions of law; entities cooperating with the administrator based on commissioned services and in accordance with concluded entrustment agreements (e.g. entities cooperating in the field of insurance protection, ICT services, such as hosting, provision or maintenance of IT systems).
6. Personal data will be processed for the period necessary to fulfill the purposes mentioned above, i.e. in the scope of concluding and/or performing the contract, for the period until the conclusion of the contract or its implementation, and after that for the period and to the extent required by law or for the implementation by the administrator of the legitimate interest of the administrator specified above. To the extent that data processing is based on consent, personal data will be processed until such consent is withdrawn.
7. The personal data will not be used for profiling or automated decision-making.
8. The data subject shall have the right granted by the European legislator to object at any time to processing of personal data concerning him or her.:
- the right of access to personal data, including the right to obtain a copy of this data;
- the right to request rectification (correction) of personal data – in the event that the data are incorrect or incomplete;
- right to request erasure of personal data;
- right to request restriction of processing of personal data;
- right to data portability where the processing is based on a contract concluded with the data subject or on a consent given by the data subject and where the processing is carried out by automated means;
- The right to withdraw consent to the processing of personal data to the extent that the processing of personal data is carried out based on consent, provided that the withdrawal of consent does not affect the lawfulness of data processing, which was made based on consent before its withdrawal.
To exercise the above rights, the data subject should contact the controller using the contact details provided and inform them of which rights he/she wish to exercise and to what extent.
9. If the processing of personal data by the controller violates the provisions of the GDPR, the data subject has the right to complain to the competent supervisory authority. The supervisory authority vis-à-vis the controller about personal data is the president of the Office for Personal Data Protection (address: Office for Personal Data Protection, Stawki 2, 00-193 Warsaw).
